Terms of Service

Effective July 11, 2026

Penny Vulture tells you which items at your Home Depot store have been marked down, and which ones look like they are about to ring up for a penny. We are not Home Depot, and we cannot make Home Depot sell you anything. Everything we show you is our best read of public product data — the price at the register is the only price that counts.

Using the site means you accept the terms below. If you do not accept them, please do not use it.

01Who you are agreeing with

Penny Vulture ("Penny Vulture", "we", "us") is operated by [LEGAL ENTITY NAME — TBD]. These Terms are a contract between you and [LEGAL ENTITY NAME — TBD] covering pennyvulture.com and everything on it.

You must be at least 18 years old to use Penny Vulture. By creating an account you are telling us that you are.

02What Penny Vulture actually does

We watch the clearance items at the Home Depot stores you pay for. We track what each item costs over time, where it sits in the store, and how much stock is left. When an item's price history matches the pattern that usually comes right before it drops to $0.01, we flag it and can send you an alert.

That is the whole product: information, refreshed on a schedule. Penny Vulture does not buy, hold, ship, or sell any merchandise, and it does not act on your behalf in any store.

03We are not Home Depot

Penny Vulture is an independent service. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to The Home Depot, Inc. or any of its subsidiaries.

"The Home Depot" and its logos are trademarks of their owner. We use the name only to say, factually, which store our data describes. Home Depot sets its own prices, its own stock, and its own policies, and can change any of them without telling us or you.

04A penny flag is a prediction, not a promise

Read this one twice.

When Home Depot marks an item down to $0.01 in its own system, that is an instruction to its staff to pull the item off the floor and get rid of it. It is not an offer to sell it to you for a penny.

A store can refuse to sell a penny item. A cashier can void it. A manager can take it out of your cart. All of that is entirely within Home Depot's rights, and none of it is something we can do anything about or refund you for.

Our penny flag is a statistical guess based on how an item's price and stock have moved. Sometimes we are right. Sometimes the item rings up at full price, or is already gone, or was never there. We do not guarantee that any item will ring up at any particular price, that it will be in the store, or that you will be allowed to buy it.

Scan it at the register or a price kiosk. Whatever it says there is the truth, and it beats anything on our site.

05Prices, stock, and locations can be wrong

Our data comes from Home Depot's own public product information, and we refresh it on a schedule rather than continuously. By the time you read a card, the price may have changed, the item may have sold out, or someone may have moved it to a different aisle.

You get 10 live re-checks per day so you can confirm something before you drive. We recommend using them. But even a live check is a snapshot, not a reservation.

We do not promise that our information is accurate, complete, or current, and we are not responsible for a trip that did not work out.

06Resale estimates are not financial advice

Some items are labelled with an estimate of how well they tend to resell. That is a rough signal built from the product category and brand — not an appraisal, not a quote, and not a promise that anyone will buy it from you at any price.

What you do with an item after you buy it is your business and your risk. Nothing on Penny Vulture is investment, tax, or business advice. You are responsible for your own taxes and for following the rules of any marketplace you resell on.

07How you behave in the store

You are a customer in someone else's shop. Penny Vulture is for finding deals that are already on the shelf — not for pressuring anyone into giving you one. When you use what we tell you, you agree that you will not:

  • Argue with, pressure, film, or harass any Home Depot employee about a price.
  • Claim to be a Home Depot employee, or claim that Penny Vulture speaks for Home Depot.
  • Hide, stash, or move merchandise so that other shoppers cannot find it.
  • Alter, swap, or damage any price tag, barcode, or label.
  • Ignore a store's instructions, its posted limits, or a manager's decision.
  • Break any law, or do anything a reasonable person would call fraud.

If a store says no, the answer is no. Take it gracefully and move on. We will close the account of anyone we believe is behaving this way, without a refund.

08Your account

Keep your password to yourself. Everything done through your account is treated as done by you, so tell us at support@pennyvulture.com right away if you think someone else is in there.

One account per person. Do not share a login, and do not resell your access.

09Paying for it

Each store you watch costs $10 per month. Adding a second store costs another $10, and so on.

  • It renews by itself. Your subscription bills every month on the same date until you cancel it.
  • Cancel whenever you want. Cancel from your account page. You keep access until the end of the month you have already paid for, and you are not billed again.
  • We do not refund partial months. If you cancel halfway through a month, that month is not prorated or refunded.
  • Switching stores has a cooldown. You can change which Home Depot a subscription covers once every 14 days. Watching a new store from scratch is expensive for us, so this stops one subscription from being walked around a whole state.
  • Free trials. Your first subscription ever, if it covers a single store, starts with a 7-day free trial. A card is required up front, the trial covers that one store, and when it ends you are charged $10 for the month unless you cancel first.

Payments are handled by Stripe. We never see or store your card number. You are responsible for any sales tax that applies to you.

No refunds for a trip that did not pan out.

We do not give refunds because an item was gone when you got there, because it did not ring up at the price you hoped, or because a store would not sell it to you. You are paying for the information, and you got the information.

10If we change the price

We can change what Penny Vulture costs. If we do, we will email you at least 30 days before it hits your bill, and you are free to cancel before then. Staying subscribed after that means you accept the new price.

11What you may not do with our data

Your subscription buys one person the right to use Penny Vulture to shop. It does not buy our dataset. You agree not to:

  • Scrape, crawl, bulk-download, or otherwise harvest anything from the site or its API.
  • Republish, resell, syndicate, or feed our data into another service, newsletter, group, bot, or app.
  • Use our data to build or train a product that competes with us.
  • Share your login, or run the site through an account that several people use.
  • Reverse-engineer the service, or try to get around its rate limits, quotas, or paywalls.
  • Attack, overload, or probe our systems, or anyone else's, using the site.

These limits are how a $10-a-month product stays alive. We enforce them.

12Who owns what

The site, its design, its code, and the analysis we produce belong to [LEGAL ENTITY NAME — TBD]. You get a personal, non-exclusive, non-transferable licence to use it while you are subscribed, and that licence ends when your subscription does.

Product names, prices, and images that come from Home Depot belong to their respective owners, not to us.

13Suspending or closing your account

We can suspend or close your account if you break these terms, if we think you are defrauding us or a store, or if we are required to. If we close your account for breaking the rules, you do not get a refund.

You can cancel your subscription at any time from your account page. To close your account entirely and have your data deleted, email support@pennyvulture.com.

14The service will change, and sometimes it will be down

We add, change, and remove features. We may have to stop covering a store, or stop the service entirely — if we shut a store down on you, we will refund the unused part of what you paid for that store.

Penny Vulture depends on data we do not control. If Home Depot changes how its systems work, parts of the product may degrade or stop working, possibly without warning. We will do our best; we cannot promise uptime.

15No warranties

Penny Vulture is provided "as is" and "as available", without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We specifically do not warrant that the data is accurate, that any item exists, that any item is in stock, that any item is where we say it is, or that any item will ring up at any price.

16Limit of what we owe you

To the fullest extent the law allows, [LEGAL ENTITY NAME — TBD] is not liable for any indirect, incidental, special, consequential, or punitive damages — and that expressly includes wasted trips, fuel, mileage, time, lost profits, and any deal you did not get.

For everything else, our total liability to you for any claim is capped at the amount you actually paid us in the three months before the claim arose, or $100, whichever is greater.

Some states do not allow these limits. If you live in one, the limits above apply to you only as far as that state allows.

17Covering us if you cause a problem

If someone brings a claim against us because of how you used Penny Vulture — including a dispute with a store, or anything in §7 — you agree to cover our reasonable costs and legal fees in defending it.

18Disputes

Talk to us first. Email support@pennyvulture.com and give us 30 days to fix it. Most things end there.

If that does not work, you and [LEGAL ENTITY NAME — TBD] agree to settle any dispute by binding individual arbitration under the rules of the American Arbitration Association, in [COUNTY — TBD], [STATE — TBD] — not in court, and not as part of a class action. Either of us may still bring an individual claim in small-claims court.

You can opt out of arbitration.

Email support@pennyvulture.com within 30 days of first accepting these terms and say you are opting out of arbitration. Nothing bad happens if you do — your account is unaffected — and you keep your right to go to court.

19Governing law

These terms are governed by the laws of the State of [STATE — TBD], without regard to its conflict-of-laws rules. Where a dispute is not subject to arbitration, it belongs to the state and federal courts in [COUNTY — TBD], [STATE — TBD].

20Changes to these terms

We may update these terms. If a change materially affects you, we will email you and post the new effective date at the top of this page at least 30 days before it takes effect. Continuing to use Penny Vulture after that means you accept the new terms.

21The usual small print

  • Electronic communications. We will send you account, billing, and legal notices by email. You cannot opt out of those while you have an account — but you can turn off deal and penny alerts whenever you like.
  • Severability. If a court strikes out part of these terms, the rest still stands.
  • No waiver. If we do not enforce something once, that does not mean we have given it up.
  • Assignment. You cannot transfer your account. We may transfer these terms if the business is sold.
  • Things outside our control. We are not liable for failures caused by events beyond our reasonable control.
  • Survival. Sections 3–7 and 11–19 survive after your account ends.
  • Entire agreement. These terms and the Privacy Policy are the whole agreement between us.
